Appealing a Fixed Penatly Notice off Police?

Yeah i adam i know what you mean, but they'll probably say "Nice excuse, must add that to the list".

Basically they dont want people doing anything that distracts from driving, even hands free setup. They will always say you should pull over first then sort out whatever you were trying to do.

It is so frustrating though when you see others doing stuff all the time, like drivin around roundabouts using their mobile, while driving sketchy.

You can appeal it Kel but the police view it as handling a phone regardless if you’re just picking it up or using it. They have the right to “do you” for handling anything i.e. eating a cake or brushing your hair, they will deem it as driving with out due care a attention. :(

wonder what the charge would be for eating a cake while brushing your hair? :homer: Jail probably

that sucks, it would have been far more dangerous to leave the phone in the footwell and risk it obstructing one of the pedals :(

lol Ian I did not mean both at the same time but I did see a lady loose her listence for putting on her make-up while driving....

Its harsh but I doubt he'll get off it. As it's been said, he could have been doing loads of things that won't be recorded, and "it fell on the floor and I picked it up" will be seen as a wank excuse, "where was it to fall on the floor in the first place?" they may ask. It's probably something that will ahve to be accepted.

sorry guys but its guilty till proven innocent these days unfortunately..

i wouldnt bother appealing it unless he was on his own in which case it may work for you but if he was accompanied, dont bother.

Yes officer, I should have left the phone to jam my brake pedal and potentially kill myself and a random family.

I'd of picked it up, if I saw an officer I probably would have pulled over to do it though.
 
Its a pisser Kelly, but not worth fighting unfortunately. I know people that heave been done for eating a bag of crisps, putting a cd in, all sorts of weird things. On the other hand a local lad badly injured a cyclist whilst trying to tune in his radio, hence the zero tolerance from the police............................

it really depends on you kelly tbh, wats the worst that would happen if you do appeal? they will just turn the appeal down.

you might get away with it so worth a shot i say, i cant stand rolling over for stupid laws.

when i was 17 i had a moped and a full car lisence, i still used my bike to commute to and from work as its so much faster threw traffic.

when you have a full car lisence its legal to not have any L plates on your bike, so i didnt.

got pulled over by a copper for having no L plates, told him that its legal but he didnt want any of it and gave me 3 points and a 60 quid fine.

many people told me not to bother appealing, and i didnt really know the law at that time, but im bloody glad i did as i got away with it.

and being 17 with 3 points isnt no good lol

doesent matter if you have got a full car licience you still need L plates,Can only ride somthing up to 15 BHP untill you pass a full bike test.The only difference having a full car licience makes is you dont need a cbt.Sorry was wrong you do need a cbt aswell if you passed full car test after feb 2001.

Reckon you could get busted in a 16hp lawn mower?

I ventured off road (In my 4x4) in a ditch once near a council car park and an omega cop car pulled over and asked what the hell I was doing in there. They warned me that a tramp lived in the bushes and I could run him over.

It took me a few minutes to get out of this ditch as the grass was so wet.

Pretty funny - it was right next to my flat.

Ps im going to contest mine, even if it cost me court fee's i think id regret not trying as i really didnt seem like i was in the wrong.
