caught speeding (Ireland)

Got caught speeding last nite at 11pm doin 77km/h in a 50 km/h zone:( Stupid, stupid...STUPID I kno!!! First time caught doin ne ting wrong in 3 years of driving and I dn't drive like dickhead either. Was jus driving home from training, away in my own little wrld not even tinkin about the limit y'kno? Neways, I broke the law, got caught, deserve to be punished..nuff said!
Just wondering wat happens next? How many pts will I get? How much of a fine etc?
 
a lad I know got 80 euro fine and 2 penaly points.

there is no way around it if you get caught there and then by the Gardai but if it had of come thru the post then there are ways of voiding the penalty points:p

I got caught doing 70 in a 60 in Telford, an i had some picky cops. Checked my car over phoned my insurance to make sure all my mods had been declared. Then brandished me with a £60 fine and 3 points i am probably 1 of the most sensible drivers too. I soon made a complaint about the lack of signs as it was a Dual carriageway with no signs so i was happy to sit at 70.

whenever you phone up your insurance company do you get a message saying that under the data protection act of 19** information can only be given to the policy holder and NOT to any third party bla bla bla...

^^^^^ Do Police have the right to seek and get information of somebody elses policy?

Thats a fair point Mully. My mate is on his mums policy and he has to get her to ring the insurance company when he needs to chk sumthin r watever as the policy is in her name and therefore protected under the freedom of info thingy. Strange one that, seems like the :cops: r above the law:flame:

How is that done? Do the gardai have to stop you when they are doing speed checks to get a fine etc.?
 
hmmm very good point. But i think they can check as it would be against the law if not insured.

well not really you have your policy on paper to show them and if they think its fake then fair enough the insurance can confirm that its valid or not but your own policy contains personal information and under the data protection act it should NOT be given out to a third party (anybody else)

Its knowing that some Police / Gardai make up the law themselves but its up to the people to prove them wrong
 
If you get a speeding fine in the post (coming from a stationary speed camera) of 80 euros. The penalty points cannot be put onto youre license until the fine of 80euro has been paid and cleared on their files.

ok send them a cheque of 90 euros and they will send a cheque back
to you of 10 euros in change. - NEVER cash or lodge the cheque they send back to you and their files cannot be closed and therefore cannot issue you with the penalty points:p - worth a try:p


^^^ although its better not to speed in the first place but its easily done in 50kph limits on the outskirts of towns etc...

Im guessing if you were caught by someone stationary with a gun, you could possibly fight it. Like find out when it was last calibrated and im pretty sure other people would know some other get out clauses.
 
And remember that it is against your own privacy for a camera to take a picture of you. - does this mean that its against the law for Police / Gardai to take pics of you while driving down past a getso van parked on the side on the road? - it probably does.

same with mobile phone records but ALL companies that have to regularly interact with the police have processes which allow them to hand over information for official legal purposes. This is covered under the data protection act.

Also I have zero points and have been pulled on numerous occassions - once they said they clocked me at 110mph which I think was a bit of an exageration but speak politely and usually they let you away... even got stopped in Alabama and they let me off... maybe I look like I need the fine money more than the government does or something :p

no its not if it doesnt show the face of the driver in the picture.

again this is covered by law... CCTV camera everywhere and footage can and has been used in court.

I Got cought doing 100km/h in a 60km/h zone back in 2006 ( i actually thought it was a 100km/h zone ). I decided to bring it to court and and chance my arm. I Got it off with it the first time in oct 2006. was Actually back in court today for it they tried to do me for it again. Got off with it again :)

Liscence Still spotless ;)

Lol, I had 3 differant things i was going to argue. all of them valid points. turns out i only needed one of them. just goes to show if you do a bit of reading and investigation it may pay off.

lol afraid not. They are taking a picture of the car, not you so it's just like you taking a picture of a nice building and people being caught in front of it.

And that "don't cash the cheque so they can't close the case" trick goes by another name - perverting the course of justice, by which you are conciously stopping the case from being closed so that you can't get your points.
