court summons 71mph in a 40

just got a letter to go to court for speeding, when i got pulled i got a fixed penenlty 3 points and 60 fine, and had to produce my licence. I produced late i thought i had 28 days to produce but i only had 7, so now i hav to go to court for doing 71 in a 40

71 was my average speed from two set markers in the road as he was following me and caught wi with puma equipment its a button they press in car over two set points which times you and works out your average speed

i dunno whether to plead guilty by post, plead guilty at court with either a solicitor or on my own

i already hav 6 points

anyone been in this situation????

Goin to court is better then by post because you get a chance to tell your story.

Trust me it helps.

and anyway if your on 6 then you'll be on 9, so you should be ok to still keep your license.

Pretty sure they can give 6 for that offence.

well i have 6, but 3 came off in october but there still on my license cos ya cant get em took off, till 5 years is it?

i been lookin on net and it says i will get 6 points or upto a 56 day ban + fine

so will i be banned if i have 9 points but 3 still on which i cant remove yet

i dont get it lol

Your best going to court, less likely to give you 6 points than if you do it by post.

Upto you though, you wont get out of it though :)

They could give 6 I think, but my understanding of it is that they can be lenient(sp) if you need your license for your livelyhood, I've seen that in the papers before.

ye i no i cant get outa it wish i produced on time, surely they have had people do the same thinkin they have 28 days to produce

and i wud rather hav massive fine than ban lol

go to court and put an innocent face on and make up areally good story like " they called you and told you that something bad happened at home " if you are lucky and he beleve you might not loose the licence

you have 6 VALID points on your licence by the sounds of things, the 3 that are no longer valid stay on there for the extra time incase you get in trouble again so the magistrate can get an idea of how you've driven in the past!

so you will be banned in you get 12 valid points in total.

it's all down the the magistrate on the day and your mitigating circumstances.

your best of seeking REAL legal advice and not listening to people on the internet and if i was you i'd attend on the day to show you give a shit about what happens! :)

been looking on internet and it says on DVLA that points stay on ya license for four years so i have six

so looks like i will be kissing my license goodbye

right,

the points will actually be on your license for 3 VALID years (FACT)

But, they appear on your license for 4 years (FACT)

5 years would be for insurance purposes, most insurers will want to know within the 5 years.

They gave you a Fixed penalty notice on the day of the offense which is 3 points, So on the date of the court hearing you explain your situation and miss-understanding of having to produce within 7 days of offense.

Say you are here to receive the 3 points given on the day.

That should 9/10 times go smoothly.

At the end of the say they can give you more but you had received a FIXED penalty so why would they give you more?

Just expalain, your guilty and and will accept the fixed penalty. They are not going to say no and change their mind and give you more.

but you will get costs slapped on too, so best out come is the original 3points & £60 fine & £43(ish) costs!

as has already been said mate go to court plead guilty, tell the truth about how you missunderstood the producer time scale and explain you need to be able to drive for work to earn your living. my uncle was done for 120 on the motorway slowing from 140! and got a massive fine and points but kept his licence as he pleaded guilty and explained he needed the car for work and 100+ is normaly an instant ban. so there is hope mate :)
