Dodgy car sale via private seller

After a bit of advice really. About a month ago, the other half decided to buy a Ford Focus via private sale. All seemed ok other than a fan belt squeak, 12 months MOT, 6 months tax. We got him down to £800 from £995 and the guy said you have saved yourself a couple hundred quid to sort the fan belt and got yourself a nice little car. The next day, a couple of warning lights came on. We basically took it to my trusted garage that day and left it with him. He had a look over, said it didn't seem that bad but could do with a brake light sensor (one of the warning lights) and as for the other half’s paranoia, she wanted the Cam Belt checked, as the seller didn't know when it was last done.

Anyhow, got the car back a week and a half later with a bill of £400. As she was driving it home, it kept kind of stalling, or cutting out completely. We got it back home, phoned my guy back up and he then came to collect.

This second look over was of everything. The code reader can't find a fault, even a car IT specialist put his machine on and they can't find a fault!!!! He did however discover that the bearings on one of the wheels was non-existent and in a nut shell – Should never have got through an MOT, the car is/was dangerous.

So, we now have a dodgy car sitting, awaiting another £300 bill. The other half starting going through her phone trying to find the sellers number, with no luck. Then randomly got a phone call from the seller later that evening, rather drunk. He basically told me, glad he found someone to get rid of it, knew it was dangerous, glad it wasn't his kids in the car, not prepared to do anything about it and had to go before he would have to put anymore of the money we gave him on his phone bill. When asked about the MOT, he said he gave his mate a couple of extra quid to put a ticket on it and he must have been on drugs or something when he did it!!!Charming guy!!!!!

I basically didn't bite as I think he was looking for a fight. I would like to go through the right channels. Police advised us to go through Trading standards who are going to be on the case and CAB have advised us to write to the seller first. Not a problem but the seller has also said he hadn't sent the V5 off yet, so we have no (full) name and address.

They have also advised us to contact VOSA due to the sellers admission of the MOT. Then I found out that the vehicle was MOT'd in Derby 5 weeks before we bought it, couldn't have been his mate as we all live in Somerset!!!!!

Just need pointing in the right direction of what to do before my better judgement gets to me and I go round with the boys!!!!!!

I dont know about the UK but in ROI a private sale has very different rules compared to dealer sales.
You have no comeback here unless:

He would not allow a mechanic of your choosing to look over the car.

He is in the motor trade,even if its nothing to do with the business he works with.

The car was in a dangerous condition and can be proved that he had knowledge of this.

Obviously the last one is what seems to fit your complaint but unless you recorded the conversation or have proof that he knowingly sold a dangerous car,at least in ROI,there is not much you can do.

As for the fake MOT,I think thats a different situation. On one hand its fraud but he can just say his friend said it was safe "Im no mechanic".

Be worth ringing a solicitor to see if you have anything worth pursuing.

You can make a complaint to vosa about the car passing the MOT. Sounds a bit backwards but it is designed to stop this sort of issue. Might not sort the seller out directly but should give the tester a kick up the ass for passing it.
