Sold as seen

Only if the seller knew there was a problem with the car before selling, but trying to prove this is virtually impossible. Had the same sort of dispute before.

Or ,in Ireland, if he is connected to the motor trade.

I sold a car 3 weeks ago the guy text me a week later saying the car is not road worthy the car come with all service history all the previous mots and current 1 valid for 6 months and also said after 600 miles the turbo went and he has got all the work done. Also he is saying he got 2 a4 sheets of paper saying the car is not road worthy I had the car for 2 weeks I been driving it without any problems. He wants compensation if not he will take it to small claims court been losing sleep over it as when the car was in my Posseion never had a problem with it. My wife and new born were in the car and I would never risk anything for them if the car wasn't roadworthy.

What specifically made it not roadworthy? If it was that bad surely it would have been noticeable when he first looked at it, not 3 weeks later???

x2, ask them to scan you over a copy of an inspection sheet and the work carried out. I wouldn't necessarily be too worried mate, as its basically the buyers responsability to ensure the car is in "good standards", which means either the buyer checks out the car and is happy to hand over payment, or they can have it inspected like RAC/AA etc.

How much was the car sold for?
End of the day it will most likely cost a small amount to pay for the court fee's, so not worth it. Probs just trying to mug you off mate. It could well be his mates garage or sommit whos knocked him up a reciept list of parts and labour trying to get the price of the car back from you.

Just say the car was fine and was mechanically sound when in my possesion, if you want to take me to court then do so, but law states that you have brought the car under your own inspection and car was sold as seen (unless stated otherwise on reciept).

Give citizens advice a ring tomorrow morning bud and see what they say, see if theres anyway you can get a copy of the act of law it comes under.

but yet nothing wrong when he looked at it??.. i know over here in ireland he wouldnt have a leg to stand on and as you have said you are no mechanic.. He has probably driven it like a c*** and done some damage himself. I wouldnt even entertain him with a reply if you sold the car and it was ok

Mate you have nothing to worry about.

If he takes you to the small claims court, stand up and say these 2 words - Caveat emptor.

The judge will then tell him to go away.

If you have a receipt mate dont worry about it. Like mossie said hes probably been thrashing it about and damaged something. Its his car now his problem. Block his number and forget it dude

In Ireland every private sale is sold as seen, the only way he can have comeback is if

You refused to let him bring a motor mechanic.

You fix, sell or are otherwise involved in the car trade.

You covered up a dangerous defect with the car and knowingly sold it as such. This bit is the hardest,he will have to prove you did it which is harder than it sounds as it can be one of the few instances where ignorance can be a defense. Your not a mechanic, how would you know?

Give a local solicitor a ring and he can tell you down the phone, but I'm pretty sure caveat emptor is the same as in the south of Ireland, plus it will give you more confidence when dealing with him.

If your losing sleep give a solicitor a ring to put you at ease, unless UK laws are radically different I can't see him having any comeback but as said,a quick phone call will tell you for sure.
