if u dont wana get done for handling then u need to be able to prove where u got the stereo mate
their evidence for that offence is u having it in your car
know a fair bit about the law as studying it at uni
will try to help if i can

I bought it off somone i met at a car cruize and he came into my work one day and said he is selling a cd palyer because hes getting a new one and would i like to buy his

If you didnt do it, you would surley get away with it!

Come on lads, i dont think he is gonna go to prison even if he did steal the stereo and they had proof of it. Not saying that you did mate. We aint got room in ouur prisons for peado's and rapists so i doubt a stereo should get you banged up now. Im assuming you got no previous history or anything like that, i would be very suprised if you got anything more than a fine and community service and thats with them proving you handled stolen goods.

to be honest your story does sound a bit dodgy but if your not guilty then your fine,the onus is with the courts to prove your guilty not for you to prove that your innocent and without evidence then your going to get away with it if you have any old story to give to them.

tosa you study law at uni yet dont know the correct spelling of mens rea?

have to agree with glanza pat, if you havent got any other kind of criminal record the chance of you going to prison is very low.

got to stay the story doesnt sound the most solid tho..

oh im soooo sorry that i mis-spelt 1 letter, i did say in my post that i wasnt sure if i spelt it correctly! jesus talk about picky!
as far as i know having good spelling has nothing to do with knowledge of the law ;)
try to have your replies planned for court, u'll be asked almost set questions so just make sure ur prepared for anything that is asked of u

You should be goin magistrates due to the value of the item in question so sentencing can massively depend on who u get (some magistrates will be harder than others)
as long as uv got gud representation then u shudnt need to worry

Ive been told the judge is very harsh tbh mate,what sort of questions do you think they will be asking me,pm me if you can cheers

they have to prove 'mens-ria'
its a term the police use along with 'actus-reas' (not sure if iv got the spelling 100%)
basically the cops have to prove guilty mind, if ur jus being charged for 'handling' then they dont expect u of stealing the item but they do expect that u had some knowledge of the item being stolen wen u bought it (this can include if u thought it MAY be dodgy)

Handling can be a very serious offence leading to a max 10yr imprisonment but only if u were involved with the theft as well

If u can convince the court that u had NO IDEA that the item was stolen wen u purchased it then u'l b fine

if i was going to be picky i would also point out that you also spelt actus reus wrong and that together they are the most important part of any conviction.

Also that its not the cops that have to prove a guilty mind but the courts the police involvement stops as soon as the person is arrested and subsequently released, i, also, study law modules at uni ;)

you idiot you should never let somebody search your car without u being present lol.. talk about planted evidence.. ask them to produce some kind of written proof that its the stolen cd player, and what date it was stolen? chances are it may of been stolen before you worked there. and if you were who was the manager on at that time? why did he allow you the keys and why arent you on cctv?

if they have non of this they have no leg to stand on. like earlier posts have said just say you bought it off a friend of a friend who was getting rid of his old cd player as he had just bought a new snazzy one.

a little lie never hurt neways especially if you didnt do it

also how did he know the serial No. of the CD player?

did he ask you if he could remove your CD player to check?!
 
they searched it when there was 2 of them there,no police were there at the time of the serch

and yes its halfords policy
