Simple answer,

If the police think you can pay the fine, they will stop you (having a nice car helps them see how much money you have)Hence you never see the old bangers stoped rom them

If you drive about in an old banger then they will rarely stop you, as it will cost more for them, as the people will not pay the fine, then it carries on and costs alot more than £30

But yes i agree, it a money spinner for them. Easy money at that.

Yep they have daily quota to fill and if they have not handed out enough fines then sadly you end up being that unlucky person who gets one for an unfair reason.

i would go to court tbh, the law is so confusing that sometimes even the police dont know wat the real rules are.

i had a simular position with when i used 2 ride my moped to work, if you have a full car lisence you dont need L plates, so i didnt have them on the bike but a policeman gave me 3 points and 60 quid fine for it, which i was quite shocked tbh.

but i argued it and read every piece of info i could into it, i talked to the local police and i talked to vosa, even asked the local bike lisence centre and they all said i need L plates, well turns out you dont because i had a full lisence.

most people would just pay up but i got away with it.

i think its very harsh 2 do you for that, especially if you werent driving erratically or dangerously.

wat difference would it make by passing a phone or maybe a water bottle?

i had £120 cost when the police took me to court in the past lol its upto you mate if you think you were hard done by then by all means go to court and plead your innocence.

Thanks for the posts guys they are hepful.

I'll probably take it to court then and represent myself. Really can't afford a lawyer. I was hoping there will be something to help me, being a student etc but it appears unlikely.

But I'm not confident being a 17 year old fairly new driver versus a old grumpy police officer.

you will probably find idrees that if you say you wanna take it to court, for 60 quid and 3 points they wont even bother!

call there bluff mate

you wont be against the officer as such, just be telling the judge what happened your version of events, and law behind it saying that what you were doing wasnt illegal etc.

Judge will then ask police officer his version etc, and then make decision on that.

Idress im pretty sure your allowed 1hour of time from a solicitor, FREE im not certaint if its a specific type but a work friend did it when he had some bother.

In that case I'll speak to a Law teacher in college tomorrow to find out for certain.

x2 if your a student not earning over i think 14k or somthing around that your entitled to Legal aid which you have to discuss with a Lawyer, some dont do it, others do, i used it for a different matter and i was entitled to an hour free of charge each session.

My advice,:( do not contest it, have seen cases similar lost very quickly:( its the handling part which is a big grey area:confused: even having a phone on your lap, could land you in trouble:slap:

Passing things round a car whilst driving, could be construed as 'driving without due care' :( you would rather have the phone charge against you:( believe me:(

Don't mean to be the bringer of bad news/advice but would hate for you to make the wrong desicion.

people have been done in the past for stupid things like eating a kit kat, banana, having a drink etc while driving, so even if contested they might still do you with something in course.

Would be great if you got away with it tho mate, stick one up the arse of scumbag coppers for the way they mistreat people but they have the law so well sewn up to screw us over

You can't go to court on one charge and be found guilty of another.

i was on my phone my car was parked in a safe place police man came knocked on my window gave me a £30 fine because my car was on and keys in ignition he said that ure car has to be off and keys out thats bullshit

I havent read all the thread Idrees just your first post all i can say is ben got fine and points just for picking his phone up off the floor from under pedals! As far as i could find out u get done for holding it never mind using it etc!

but thats dodgy leaning right over to get the phone from your pedals

i would go to court, the copper might not turn up remember he has got to waste a day going to court for such a silly matter, and sometimes you might get a decent magistrate who knows what coppers are really like - lieing bastards, just tell them my mate passed me my phone back -cos he/she was using it and i put it in my whereever, whats the difference if it was a phone or a pack of fags i wasnt using it.

To be honest i dont think it would bother the police where you were picking the phone up from it is illegal regardless.

And to be fair im sure the magistrate also knows how members of the public lie in court (I know Idrees isnt) Some police do go on these huge power trips but some are there to help so you cant tarnish them all with the same brush.

But it would look quite dangerous to a police officer and I'm sure they could argue that Ben should have pulled over to pick up the phone?

Sean yeah I know what you mean, I've been stopped by some officers who are really nice and they just check the car out so they can't all be the same!
