Sean yeah I know what you mean, I've been stopped by some officers who are really nice and they just check the car out so they can't all be the same!

true but he was in stood stil traffic going nowhere so why bother? anyway point is we paid the fine and took the points as when ppl explained how just having it in your hand is enough evidence not much u can argue.

Damn that's a bummer. I dunno what to do. If I get 6 points in the first two years my licence will be revoked and that's what is bothering me most. Otherwise I wouldn't have been so bothered even though I didn't do much wrong.

Well maybe it will work better for you if a third party i.e a judge hears your side of the story! only you can decide though :(

I know you have added a poll, will it do any good?

If the poll turns out that you should take it to court, will you?

Your issue seems to be more about losing your license by getting 6points in the first two years, could happen but in fairness probably won't, its just what worrying about it does to you.

If it was me, I would be peed off about it but, I would pay the fine and take the points.

The hardest part is deciding what to do, I know that, just think the poll is not the best way to go about it.

I got 3 points in my first 2 months of driving when i was 17.

I was also very worried because 3 more and i would have lost my licence but i was carefull and got through it.

If you do decide to take the points just be carefull and you will be fine:)

Insurance wise it did not really make much of a difference so that was not a problem.

I probably won't go with what the poll tells me but it's just an easier way of getting people's opinions. Especially those who can't be arsed to post. :)

My car does seem to get a lot of attention from cops, I've been stopped around 5 times since it's been on the road. And that's what kinda worried me.. I'm scared I might get another 3 points for something just as stupid as this!

Carry a note pad in the car, when stopped take notes of everything, names/numbers etc of people that stopped you, time, date, conditions etc etc

Make it clear to whoever stops you that you are doing it, along with noting the reason why you have been stopped. When asked why? Reply by saying that you have been advised to keep note, due to the frequency and nature of the stops.

Word will get round very quickly;) and your problem will go away;)

whats the worse that could happen if you take it to court? you get the 3 points and a fine and possibly court fees.

i think theres more chance of them not even turning up for it than giving you the points!

i bet they cant be assed

I worry just as much as you mate, i got 3points in my first year of driving and thought my life was over, just had to watch my speed and make sure tyres had tread, washer bottle has water in etc etc, think its pretty harsh for just passing your phone, I got pulled for checking the time on my phone but they let it go as i already had the 3points.

yeah there are ok coppers out there but there also alot of snide jumped up bstards , trust me ive got personal experience, ive also had my solicitor rip coppers to bits and the magistrate believed me over the police

all the things i have read on here about getting done when parked etc is an absolute piss take, i agree you should get done for using your phone when driving but this is madness.

The colour of your car dont help matters and it been highly modified cosmetically, when i had my focus st orange clio and i was forever being pulled over it was annoying me to high heaven and that was loud and highly modified. Have they marked your car?

I like that idea!!! My mates mother went down to the local garda office and ate the local gaurd for stopping him the whole time for stupid things and he drives a landrover!! He never gets any bother anymore.

I would take it to court. If the copper was riding along side you then he would have seen your friend giving you the phone. So he is just acting the cunt imo.

Not long ago a lassie in the paper got done for eating an Apple, while driving.

It will cost you more in the long run if you take it to court.

would recommend everyone does this. I went through a period of being stopped everytime I left the house in my glanza. They kept getting me to produce my tax and insurance documents at the police station even though I had them in the car to show they were just trying to be idiots. So I spoke to the station sergeant and he told me to carry a notepad and pen and as soon as they stop you tell them that you have been stopped frequently for no reason and have been advised by your local police station to take all details including their name and why they stopped you. Man I got stopped twice more and said this and their attitude immediately vanished and I was never asked to produce again.

best thing is speak to a lawer and see what he say...
rember when i said they though i didnt have insurance this was the first day i got my car, then they took the car away payed the 100 fee, then they said there going to take me to court... 9 months down the line havent heard nothin since, wankers think they know it all i EVEN got a letter from the insurance company that the manger rite for me and for the court if then tooken me to court to back me up, one thing they would off made them self looked like a fool then i would off put it in the paper,
