I wish i hadnt just been calm about it at the time now, i though he would respect that and caution me.

i cant really say i broke down, as its right outside the enterance to the Uni... and its the only building on that road

have your tried calling/writing to the Central Ticket Office? might be worth seeing what they say!

if not your only real other option is to request a court hearing and putting forward your mitigating circumstances to the magistrates and hope they take a lighter view on a the matter :)

yea its a fixed penilty.

i presume it get put on some database a the end of there shift? the only thing it in the scenrio you have to psyhically look at the place to proove its not as bad as they make it out to be.

you can include Photo's in your mitigating circumstances, tbh you could just come away with the same £60 3points and court costs, but it's all down to the magistrate on the day!

you been to the citezens advice bureau? i'm sure they must have some guys clued up on motoring law that might be able to give you some advice?!
 
ive gone aginst them for doing me 3 points and 60quid fine for goin through an amber light and becoz theys got no footage im still waiting for a reply to go court ( 6 months down the line ) only thing is they still got my lisence lol =[ no track time for me

appeal mate what u got to lose?? the fine will stay the same they cant up it



If you are going to contest any "minor" motoring offence NEVER surrender your license. They cannot make you if you chose to have it heard at court. The reasoning is, if you contest it, it is your belief that you have done nothing wrong, so hang on to your license :)

no idea where my local one would be, dont really fancy paying 150 onto of everyone else if it failed photos would be good, but that means traveling back there to take them

Dave i still have my licence at the moment, i only had the card part with me (because who carriers there paper part about!)

he did ask me me to sign something that was optinal and i did in teh spare of teh moment, no idea what it was though. its on the ticket

think the C.A.B might be online too, if not google your local one!

you can do court stuff all by post, alough i'd if you go in person it might look a bit better in court!

if you fail to surrender within them 7 days your basicly gonna get hit with it being registered with your local court as a fine and going up by 50% (depending on how they do things by you).

not sure what you would of been asked to sign other then the FP, maybe some questionaire thing to 'improve' policing.

ill scan the slip tomorrow and put it up, i think it was just the penilty notice i signed but why is it optinal? ill leave it a few days and think but i go to my local station to produce.

signing the conditions of the fixed penalty i guess, the FP was designed to stop everything going straight to court, so i guess if you didn't agree to the conditions of the FP with the option to go to court they would just hit you with a summons and take you straight to court!

not 100% sure on that tho! :confused:

ah that seems to make scence. also explans why its called a fixed penilty, as it sounds like its a negotiable price ticket lol
 
With any fixed penalty they ask you to sign it, which does not take away your right to contest it, as you may not have all the legal info to hand. Remember the police are only there to uphold the law, many don't actually understand the laws and there are many laws that contradict one another. If you choose to defend it, get a lawyer or a legally minded person to "assist" you. If you go to court question everything you don't understand as it’s your right to have matters explained in plain English (they hate that). If you don't you will be found guilty before you know it!

my uncle is a qualified barister, i might have to spill the beans and just ask him.

he dosnt do this for a living as he had a career change so not sure but hes an intelligent person.

just though i would update this as it has been over a month now and i never did give the outcome.

When i went to the poilce station to produce my documents and contest against the ticket, the guy at the counter said i have the wrong copy, i acutally had the police copy, at the time i didnt realize as i was too annoyed the examine the ticked but correct it said police copy all the way around the outside of the ticket. so i asked the guy at the counter "surly this renters it void" and he said im not to sure ill send an email to the offering on duty and its down to him to get back in contact with me.

so its been over a months scince then i i havent heard anything so im hoping that he got theemail and saw the scenerio from the POV of a normal person and has let it go.

but rest assured if i do heard anything i will be going to court to fight it, and i still have the ticket to show it was incorrectly issued :)
