suppose if u dont ask u dont get, but i cant see them giving me courtesy car as they still havnt really claimed responsability yet no harm in askin i suppose

bad luck man, but as the guys have said ask for everything fella,
i mean it is their fault that the manhole cover was not doing its job, after all that what our high tax rate hould be paying for.
get quotations from several garages mate, ( i am right u r the GT i spoke to on here from Rayleigh) ?.
with those quotes from garages then u can compare the price to toyota, and prove that it can be repaired a lot cheaper.
but unforunately the council will most likely write it off and give u cash.
if u r the lad from rayleigh and need a hand, i only down the road fella, so i can help if it is required .

cheers mate appreciate the offer and yer i am the one from rayleigh, and i think if the repair bill is over 2000 then reckon they will just right it off

i hope not mate, but seriously 2k bit low car worth a lil more than that.
and u can get a forged lump for 1800 brand new, so a standard one obv be cheaper, but like u say money is tite for all of us atm.
keep chasing tho mate, cus xmas is coming and council be even harder to chase, probs best get somewhere b4 xmas..
have the council got to send someone round to look at it?

i think the fault is with anglian water as they are the ones dealing with it, i see what your saying about the forged lump but u cant buy new standard engines anywere apart from toyota and someone said they could be like 4 grand which is worth more then the car lol and forged engines are on exchange basis and i havent got an engine to exchange lol and i dunno if there sending someone round as they have just started investigation

a new engine and turbo assembly is like 4.5k

yh at that price, it be a write off, but then as u said u break it, would u then use the money from breaking for another motor?
or to put away fro another engine ie a forged lump?

i dunno dependin on how much IF i got any money might fix the starlet then maybe sell and put the rest to another motor, or go forge i dont wanna get to far ahead of meself as it will probably take a while or they will probably just say no lol

right people back again with another update anglian water have got back to me and denied it there responsibility so i am going to get a solicitor involved to see if i have a case if so will be taken to court, if not then the car is goin to be sold

damn, gutted... I hope you win your case as it's so hard to get anything out of a business but it CAN be done! Good luck!

well basically sent me a letter saying that due to the adverse weather conditions they could not be held accountable for the incident, so who is then?

adverse weather conditions is no excuse and i hope you let them no that, the company i work for puts in manholes every other week infact right now we are doing a big sewer line, a manhole shudnt just collapse because of rain its obviously been there a long time and has started to decay or its possible it was even lately put in and not done so properly i hope you took pics of the manhole and if i were you id get on to your local council.

sorry to hear of this - do some legal research yourself mate - but best advice I can think of is get a solicitor right away. Most of them offer an initial consultation free of charge for fist 30 minutes - which should be enough to find out your legal rights etc. imo they should advise you to get a civil engineers report done asap which will help your case. You need expert evidence and seem to have witnesses etc so I would take it all the way - the council /anglian water will deny all liability at first but might back down when you show you are serious and they have solicitors/experts opinions put to them.

I just came across this case involving potholes - not quite the same but worth a read through..for the lazy ones it basically is a woman steps into a pothole in the dark when its been raining,trips hurts her leg claims damages - wins the case cos she is able to prove pothole is more than 40mm deep.gets £5k damages.
